Divorce & Separation
Going through a separation or divorce is a very stressful and upsetting experience. Our aim is to provide sensitive advice with decisive action and to provide a first-class service with minimum stress. If it looks like your relationship is over it is important that you contact us immediately so we can advise you of what steps you may need to take from the outset so you are properly advised before making any important decisions. We can provide expert advice on child arrangements, separation agreements, judicial separation, divorce and financial matters relating to the breakdown of your marriage.
In order to obtain a divorce, you need to demonstrate to the court that the marriage has broken down irretrievably. To do this you need to rely on one of the following supporting ‘facts’:
- That your spouse has committed adultery
- That your spouse has acted in such a way that it is unreasonable for you to be expected to continue living with them
- That your spouse has deserted you for two years
- That you and your spouse have lived apart for two years and your spouse consents to the divorce
- That you and your spouse have lived apart for five years, whether or not your spouse consents to the divorce
Children Issues
Our children always come first and you need to get the right advice and make the right decisions regarding your children from the very start. We can advise on any issues relating to your children that arise from a Separation and represent you in any Children’s Order proceedings.
Some issues that may arise are:-

If these issues cannot be resolved amicably than we will make an application to Court on your behalf to safeguard the interests of your children. Sorting out financial issues after a break-up can be particularly stressful especially deciding what happens to the Joint or Matrimonial Home. It is very important that you contact us as soon as possible before making any decisions so that we can give you the best advice about the various options available to you. We can advise you on Spousal Maintenance, Transfer of Property, Pension Sharing, Lump Sums and Child Maintenance and ensure that your position is protected and no rash or emotional decisions are made by you.
Co-Habitation
The Law treats unmarried couples differently to married couples. This area of law is quite complex and we can help couples who decide to live together and not marry by resolving any legal issues or by preventing future problems by advising on entering into a cohabitation agreement. Civil Partnerships
Same sex couples who enter into a civil ceremony have very similar legal rights as a married couple. Children who are born to either partner are treated as children of the family. If a situation arises whereby the parties separate, the partners are entitled to apply to the court for similar financial orders as divorcing couples.
